NADAT ek die storie verlede week in die Paarl Post gelees het oor die koopkragmoleste, en ekself as huurder al teleurgesteld moes omdraai, het ek toe bietjie regsadvies gaan vra.
Die inligting wat ek toe kry, is dat huurders wel ook eers skriftelik in kennis gestel moet word indien geld sommer so afgetrek kan word vir uitstaande erfbelasting.
En dan moet hulle glo ook eers in die hof verskyn voordat dit goedsmoeds afgetrek kan word.
Ek sal graag wil hoor wat die Munisipaliteit hieroor te sê het.Ook ’n huurderMay Carolissen, the Head of Media & Communication of the Drakenstein Municipality, reacts: In terms of the Municipal Systems Act of 2000 and the Municipality’s debt collecting policy, we have acted within our rights by recouping property rate debt of the owner via the pre-paid electricity payments of the tenant.The Municipality is allowed to block a tenant’s pre-paid electricity to recover the arrears, even if it is for other rates and services, which is the owner’s responsibility. It is furthermore correct that we can enter into an agreement with the tenant or the estate agent to recover the owner’s debt on the property from the rent payable by the tenant (as stipulated in the Systems Act of 2000 sect.104(f)iii).
